Terms of Use

These terms govern your use of Magic Booth — the Magic Booth iOS application and the services behind it (together, the Service), operated by Staxel (we, us). By creating an account or using the Service you agree to these terms. If you are using the Service on behalf of a business, you agree on that business’s behalf and confirm you are authorized to do so.

1. What the Service is

Magic Booth turns an iPhone or iPad into a photo booth: guests are photographed, and the Service uses third-party AI image models to produce a stylized version of the photograph, which the guest can retrieve. You — the operator — configure booths, choose looks, and run them at your venues and events. Guests interact with a booth you operate; they are your guests, not our customers.

2. Accounts and workspaces

  • You are responsible for what happens under your account and workspaces, including what members you invite do there.
  • Keep your credentials to yourself; tell us promptly if you believe they are compromised.
  • We may suspend a workspace that violates these terms. A suspended workspace keeps its data and its history; it cannot generate new photographs until the suspension is lifted.

3. Subscriptions, credits, and payment

  • Paid plans are auto-renewing subscriptions purchased through Apple. The price, billing period, and plan options are shown in the app before you buy. Payment is charged to your Apple ID; Apple, not us, processes it.
  • Your subscription renews automaticallyunless you cancel at least 24 hours before the end of the current period. You can cancel any time in your device’s Settings under your Apple ID subscriptions; cancellation takes effect at the end of the period already paid for.
  • Each billing period grants your workspace a plan-specific allowance of credits. Generating a photograph spends credits. Whether unused credits carry into the next period depends on the plan and is shown where the plan is offered.
  • Credits have no cash value, are not redeemable for money, and belong to the workspace they were granted to. We may grant promotional or trial credits; those are a gift, not a purchase.
  • Refunds for purchases made through Apple are handled by Apple under Apple’s terms. If Apple refunds a subscription period, the credits that period granted are withdrawn from the workspace, up to the amount still unspent.
  • We may change plan pricing or allowances. Changes to a subscription price follow Apple’s notice and consent process and never take effect silently mid-period.

4. Your content and your guests

  • You retain ownership of the content you bring — reference images, prompts, overlays, and configuration. You grant us the license needed to store and process that content in order to run the Service, and no wider.
  • Photographs taken in a booth are processed to produce the stylized result, held so the guest can retrieve it, and deleted 30 days after capture — see the Privacy Policy for details.
  • You are responsible for your guests: for telling them their photograph will be taken and processed by AI, for obtaining whatever consent your jurisdiction and venue require, and for the guests being lawfully allowed to be photographed. For minors, that consent must come from a parent or guardian.

5. Acceptable use

  • Do not use the Service to create content that is unlawful, or to harass or defame anyone.
  • Do not photograph people without their knowledge, or use the Service for identification, surveillance, or profiling of any kind.
  • Do not probe, overload, or interfere with the Service, resell access to it, or attempt to obtain credits other than through the Service itself.

6. AI-generated output

The stylized photographs are produced by machine-learning models. Output is not fully predictable: it can be inaccurate, unflattering, or occasionally fail entirely. A generation that fails is not charged. We do not guarantee that any particular output will be produced, and you should not present AI output as an unedited photograph of a person.

7. Availability and changes

We work to keep the Service available but do not promise uninterrupted operation. We may change or discontinue features with reasonable notice where the change is material. You may stop using the Service at any time; deleting your account ends these terms except for the sections that by their nature survive.

8. Disclaimers and liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties and our total liability arising out of the Service is limited to the amount you paid for it in the twelve months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited.

9. Governing law

These terms are governed by the law of the jurisdiction in which Staxel is established, without regard to conflict-of-law rules.
